Liability Waiver and Policies:

1.Liability Waiver:

The Dog Talker LLC (formerly VivaPaws LLC) will endeavor to create as safe an environment as possible for the training of a client’s puppy/dog and will endeavor to offer only sound, safe, and responsible training and training instructions. However, The Dog Talker LLC is not responsible for any unintentional errors, omissions, or incorrect assertions on the part of the client or his/her family/helpers, etc. The recommendation of any other product or service is not a guarantee of a client’s satisfaction with that product or service. Further, the client is, and will remain responsible for the actions of his/her puppy/dog at all times. The client hereby agrees to indemnify and hold harmless The Dog Talker LLC, its officers, directors, instructors, agents, employees and/or representatives of any and all claims, or claims by any members of the client’s family, or accompanying guests of the client of injury, expense, costs or damages to the client, the client’s puppy/dog, or any handler sponsored by the client.

In addition, client agrees that he/she will defend and indemnify The Dog Talker LLC for any injury, expense, costs or damages to any dog handlers or dogs, whether sponsored by the client or not, or to third parties arising out of the client’s own actions or the actions of the client’s puppy/dog. Client will be required to sign a Service Agreement that client has read the above-stated provisions, and agrees to accept those responsibilities.

2.Refund

The Dog Talker LLC is a Professional Service Provider. Client is not entitled to a refund of fees. No exceptions. No refunds are issued for package/program sessions if the owner doesn’t use all the sessions, re-homes their dog, or ‘drops out’ of training. Sessions can be transferred with the dog, provided the new home is within the service area.

3.Video & Photo release:

Client grants permission to The Dog Talker LLC and its legal representatives and assigns, the irrevocable and unrestricted right to use, publish and broadcast the client’s photograph(s), likeness and voice, including via video, for trade, advertising, and any other purpose and in any manner and medium; and to alter the same without restriction. Client hereby releases The Dog Talker LLC and its legal representatives and assigns from all claims and liability relating to said photograph(s), video(s), likeness and voice.

4.Service Agreement

Upon purchasing any of The Dog Talker LLC’s service products, client will be required to sign a Service Agreement electronically.

5.Payment Plans for Behavior Programs

By agreeing to pay a Behavior Program in monthly installments, client understands that he/she has committed to the FULL length and FULL payment of the Behavior Program as stated in the Description of Services in the Service Agreement, regardless of whether the client chooses not to complete the program.

6.Scheduling

All purchased services are scheduled directly in agreement with The Dog Talker LLC and are subject to availability. Client may choose to either book a FREE 30 mins call before purchasing any service product, or contact us via our contact form, email, or phone. As soon as a client has purchased one of our service products, we will reach out to the client within 24 hours to schedule said service product.
